The Florida Supreme Court unanimously ruled against 64-year-old John Errol Ferguson today, saying a judge was right in denying a mental competency hearing for the inmate. Ferguson is scheduled to be executed next week on October 16 for the killing of six people in Miami in 1977.
Previously, circuit judge Nushin Sayfie ruled that while Ferguson “undoubtedly suffers from mental illness,” he had waited too long to ask for a clemency hearing. The state Supreme Court affirmed Sayfie’s decision.
